pretty sure as long as the sample is 3 secs or less you're fine.

kraftwerk had a whole legal battle about it, that'd be a good place to start looking.

im not too worried about it personally. i think as long as you take the sample out of it's original contexts and use it in a unique manner, it probably wont even be recognizable.

if you're just rippin someone's shit, you deserve to be sued. Wink
